SIRIN LABS LIMITED WARRANTY

 

This SIRIN LABS limited warranty (“Limited Warranty”) replaces all other SIRIN LABS warranties and liabilities, whether oral, written, (non-mandatory) statutory, contractual, in tort or otherwise, including, without limitation, any implied conditions, warranties or other terms as to satisfactory quality or fitness for purpose, to the extent permitted by applicable law.

The benefits given to you by the Limited Warranty are in addition to other rights and remedies you may have under your country’s consumer laws or any other applicable law, in relation to the applicable SIRIN LABS product to which the Limited Warranty relates. SIRIN LABS Limited Warranty does not exclude, restrict or modify any statutory rights or remedies, which cannot be excluded under any applicable law.

    1. WARRANTY PERIODS

 

SIRIN LABS provides warranty for each of its products and the warranty duration varies per product (each, a “Warranty Period”), as follows:

      1. For the mobile phone – twelve (12) months (Twenty-four (24) months in all EU countries) as of the date of purchase; and

      2. For all technical accessories (including earphones, chargers adapters and cables), – six (6) months as of the date of purchase.

 

As far as your country-of-purchase laws permit, the particular Warranty Period will not be extended or renewed, or otherwise affected due to subsequent resale, or authorized repair or replacement of the applicable product. However, any part repaired or product replaced during the Warranty Period will be warranted from any defect for a period of 6 months from the date of repair, or for the remainder of the original Warranty Period, whichever is longer.

    1. WHAT IS COVERED

 

During each Warranty Period, SIRIN LABS will repair, modify or replace, at SIRIN LABS’ sole discretion, any defective parts, or any parts that do not properly operate for their intended use, provided that notice of any claimed defect has been submitted to SIRIN LABS within the applicable Warranty Period. Subject to the Limits of Warranty set forth below, you will not be charged for the repair or replacement of any of the products.

In addition, SIRIN LABS provides you access to technical support via chat or email during the applicable Warranty Period. Technical support is provided in the English Japanese and Korean languages and during regular business hours.

    1. LIMITS OF WARRANTY – WHAT IS NOT COVERED

 

The Limited Warranty does not apply to:

Any damage to or defect in (other than manufacturing defects) the appearance of the product (i.e., decorative damage, scratches, dents and cosmetic damages).

Any damage resulting from an accident, negligence or exposure to: liquids, sand, chemicals, fire, extreme thermal or environmental conditions, or improper handling, nor does it apply, on a more general basis, if there is evidence of misuse or abuse.

Any damage resulting from repair services provided anywhere other than at an official or recognized SIRIN LABS repair center.

Any damage caused by normal wear and tear or otherwise due to the normal aging of the applicable product.

 

Any damage resulting from the use of accessories not approved by SIRIN LABS.

 

Any damage, corruption or loss of: data, software, settings, content, links or crypto money, collectibles or assets, whether included in or downloaded to the product, whether included during installation, assembly, repair and shipping or at any other time in the delivery or repair chain or otherwise and in any way acquired by you.

The Limited Warranty provides service coverage according to shipping address in countries where Sirin Labs offer service center services (“Territory”). Outside the Territory, service options may be limited due to technical issues outside of SIRIN LABS’ full control and, if possible, may be subject to additional charges.

Notwithstanding the foregoing, in the event that relevant public authorities notify SIRIN LABS that the product has been stolen or if you are unable to deactivate passcode-enabled or other security measures designed to prevent unauthorized access to the product, and you cannot prove in any way that you are the authorized user of the product (e.g., by presenting proof of purchase), then the Limited Warranty shall not apply to you.

    1. HOW TO OBTAIN WARRANTY SERVICES

    1. WHAT WILL HAPPEN IN CASE OF WARRANTY SERVICES?

 

  • Return of Defected Product

 

You will be requested by Sirin Labs support to return your product to one of Sirin Labs’s service center facilities.

  • Time of Service

Service time is defined as the time taken from the time phone has reached an authorized Sirin Labs’ service center and the time it is ready to be picked up by a shipment currier, and will be no longer that 14 working days

  • Repair and Return

Upon completion of repair or replacement, your product can be either picked up by you or it can be sent to you via door to door courier service (provided the shipping address is within supported territory), at your discretion. Delivery is dependent on third -parties which are outside Sirin Labs control and thus, in no event Sirin Labs will be liable for any delays

  • Warranty Services outside the Territory

In the event that you are located outside the Territory, the Limited Warranty services described above will be provided to you on a DDU (Incoterms 2010) basis and you will be responsible for any taxes and customs payments.

Courier delivery or pickup outside the Territory will delay the delivery of repaired phone (from the request date and from the completion of the repair service, respectively), excluding the actual time of repair.

    1. OWNER’S RESPONSIBILITIES

Backup all your data and other information regularly to protect your content and against operational failure.

Before submitting your product to repair, backup all your storage, remove all personal information, disable all security passwords, transfer you crypto assets balance to another crypto wallet account. And remove your SIM card. The contents of your product storage media may be erased, replaced and/or reformatted in the course of service

SIRIN LABS may return your product with an updated version of the software.

You will be responsible for reinstalling all your software programs, data and information. Recovery and reinstallation of other software programs, data , information and Crypto assets are not covered under this Limited Warranty.

 

You may seek service in a country that is not the country of purchase. In such a case, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges.

 

    1. OTHER IMPORTANT WARRANTY NOTICES

 

  • SIRIN OS™ software

 

The “SIRIN OS™ software” is the software and applications preloaded or downloadable onto your device and owned by SIRIN LABS and its affiliated companies and its licensors, which includes computer software and may include associated media, printed materials, “online” or electronic documentation in connection with your use of the product.

  • Third Party Sources and Content

 

The SIRIN OS™ software enables you to view, access, link to, and use content from Third Party Sources (as defined below) that are not owned or controlled by SIRIN LABS (“Third Party Content”). The SIRIN OS™ software may also enable you to directly communicate and interact with Third Party Sources. “Third Party Source(s)” means: (i) third party websites, applications and services; and (ii) our partners and customers, including, without limitation: (a) Koolspan Inc., which End User License Agreement may be found at https://koolspan.com/terms-and-conditions/ ; and (b) Zimperium Inc., which End User License Agreement may be found at https://www.zimperium.com/files/EULA.pdf

 

    • SIRIN LABS is not affiliated with and have no control over any Third Party Sources. SIRIN LABS does not assume any responsibility for the content, terms of use, privacy policies, actions or practices of, any Third Party Sources. Please read the terms of use and privacy policy of any Third Party Source that you interact with before you engage in any such activity.

    • SIRIN LABS is not responsible for, and expressly disclaims all warranties regarding, the accuracy, appropriateness, usefulness, safety or intellectual property rights of, or relating to, any Third Party Content.

    • SIRIN LABS does not endorse any advertising, promotions, campaigns, products, services or other materials that are included in any Third Party Content or that is communicated to you from a Third Party Source.

    • By using the SIRIN OS™ software you may be exposed to Third Party Content that is inaccurate, offensive, indecent or objectionable. You always have the choice of deciding whether or not to interact with a Third Party Source or to view and use Third Party Content. Your interaction with a Third Party Source and your use of, and reliance upon, any Third Party Content is at your sole discretion and risk.

    • You are solely responsible and liable for your interaction with a Third Party Source. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against SIRIN LABS, and release SIRIN LABS from any and all liability, arising from your use of and interaction on any Third Party Content and from your interaction with any Third Party Source. If you have any query or complaint regarding a Third Party Source or any Third Party Content, you agree to contact the Third Party Source directly.

 

  • Warranty Disclaimers

 

    • THE SIRIN OS™ SOFTWARE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, REPRESENTATIONS, WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE.

    • SIRIN LABS DOES NOT WARRANT THAT THE SIRIN OS™ SOFTWARE WILL OPERATE ERROR-FREE, THAT THE SIRIN OS™ SOFTWARE IS FREE OF VIRUSES OR OTHER HARMFUL CODE OR THAT SIRIN LABS WILL CORRECT ANY ERRORS IN THE SIRIN OS™ SOFTWARE. YOU AGREE THAT SIRIN LABS WILL NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENCES TO YOU OR ANY THIRD PARTY THAT MAY RESULT FROM TECHNICAL PROBLEMS INCLUDING WITHOUT LIMITATION IN CONNECTION WITH THE INTERNET (SUCH AS SLOW CONNECTIONS, TRAFFIC CONGESTION OR OVERLOAD OF SIRIN LABS’ OR OTHER SERVERS) OR ANY TELECOMMUNICATIONS OR INTERNET PROVIDERS.

    • IF YOU HAVE A DISPUTE WITH ANY OTHER SIRIN OS™ SOFTWARE USER, YOU AGREE THAT SIRIN LABS IS NOT LIABLE FOR ANY CLAIMS OR DAMAGES ARISING OUT OF OR CONNECTED WITH SUCH A DISPUTE. SIRIN LABS RESERVES THE RIGHT, BUT HAS NO OBLIGATION, TO MONITOR ANY SUCH DISPUTE.

    • NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SIRIN LABS SHALL BE DEEMED TO ALTER THIS DISCLAIMER OF WARRANTY, OR TO CREATE ANY WARRANTY.
